SERVICE PRICES AND HOW THEY ARE DETERMINED

The prices of the services offered can be found in the applicable price list at shop.actalis.com

The price does not include a delivery fee as it is a digital service.

CONTRACT DURATION

The duration of the Contract is set out in the purchase order completed by the Customer based on the chosen service.

PURCHASING SERVICES

The products and services can be purchased at shop.actalis.com.

The products and services are delivered to the Customer subject to the correct completion of the respective Form, upon acceptance of these General Terms and Conditions of Supply and following successful verification of the activities described in the CPS (HYPERLINK https://www.actalis.it/documenti-en/cps_for_ssl_server_and_code_signing_en.aspx). The procedures, terms and conditions for the issue, suspension and revocation of the Certificate are specified in the CPS.

The Contract documentation consists of the documents, as indicated in Article 3 of the General Terms and Conditions of Supply, that apply to the chosen service.

The Customer may purchase the service by following the steps set out in the cart upon accepting the General Terms and Conditions of Supply at the end of the order summary.

The General Terms and Conditions of Supply shall be attached to the confirmation email.

INFORMATION ON WITHDRAWAL

The Customer, which can be described as a "consumer" in accordance with Article 3 of Legislative Decree 206/2005 (the "Consumer Code"), may exercise the right to withdraw according to the methods and procedures set forth in Articles 52 et seq. of the Consumer Code within 14 (fourteen) days from the date of signing the Contract for Services and 14 (fourteen) days from the date of delivery for Products, without any penalty and without providing a reason.

More specifically, the Customer must expressly state its intention to withdraw on the form available at https://shop.actalis.com, or provide any other explicit declaration of its intention to withdraw from the Contract, by sending notification of withdrawal by registered letter with confirmation of receipt to Aruba PEC S.p.A., Loc. Palazzetto 4 – 52011 Bibbiena, or by certified email (PEC) to [email protected]

EFFECTS OF WITHDRAWAL

In the event that the right to withdraw from the provision of Services is exercised, the Suppliers shall reimburse the Customer, without undue delay and in any case within 14 days from the date on which the intent to withdraw from this Contract was communicated, all payments received, by using the same means of payment used by the Customer for payment, or as agreed with the Customer without any cost being incurred by the latter as a consequence of the reimbursement.

LEGAL GUARANTEE

Regarding the supply of products, where applicable, the product guarantee is specifically provided for in the General Terms and Conditions of Supply.

PAYMENT METHODS AND TIMESCALES

Payment is only due once at the time of purchase.

Payment for the Service must be made using the methods indicated at https://guide.actalis.com/en/home.aspx;

Any payment made by the Customer shall bear a specific identification number and for this Actalis shall issue the respective invoice within the month in question. The VAT due shall be applied to all invoiced amounts, which, together with any other tax charge resulting from implementation of the Contract, shall be borne by the Customer.

FEATURES OF THE SERVICE - MAIN CHARACTERISTICS

The purpose of the Contract is to issue the Certificate to the Customer in accordance with the technical characteristics, type and procedures stated in the Form and in the Technical Specifications of the Certificate itself.

The Customer undertakes to use the Certificate in accordance with the Terms and Conditions, CPS and Technical Specifications, in accordance with the law, applicable legislation, ethics and public policy. For example, the Customer undertakes to refrain from committing a system or network security breach that may result in civil and/or criminal liability, not to use the Certificate in such a way that is detrimental to itself, to third parties and/or to the Supplier, and to only use the Certificate for the uses permitted by law.

COMPLAINTS

Aruba provides its Customers, via the support site, with an electronic means of submitting complaints, subject to the completion of forms provided in the portal.

If, in any case, the Customer decides not to use the portal, it may submit its request by certified email (PEC) to the channels mentioned above, making sure to enter the following information as a minimum:
  1. the Customer's identification data (name, surname and tax ID number) or username;
  2. the name and type of the service;
  3. a description of the disputed facts and any request for assistance already submitted

INITIATING CONCILIATION PROCEEDINGS

The Customer may initiate conciliation proceedings before the competent CORECOM or other conciliation bodies specified by law.

ConciliaWeb has been up and running since 23 July 2018, and is AgCom's online platform for submitting requests to settle disputes between users and operators. A Conciliation Request can also be sent via the ODR platform referred to in EU Regulation no. 524/2013, managed by the European Commission and available at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage.
